1. ABOUT THESE TERMS
These terms apply to services supplied by Tri Fitness Limited (company number 56858), trading as TRI FITNESS Performance and Swim Smooth Channel Islands. They cover coaching memberships, squad sessions, 1-to-1 coaching and video analysis, training camps, clinics and other activities advertised through www.3fit.co.uk or our booking providers.
By purchasing, booking or participating in a service, you agree to these terms and to any specific information shown at checkout or provided for that service. Where service-specific terms differ, the terms clearly presented when you book will apply.

2. HEALTH, SAFETY AND PARTICIPATION
You are responsible for making sure you are medically and physically able to take part. Please tell the coach before a session about any injury, medical condition, medication or other matter that could affect safe participation. Seek advice from a qualified medical professional if you are unsure.
Swimming, cycling, running, strength training, triathlon and open-water activity involve inherent risks. These can include slips, falls, collision, adverse weather, traffic, equipment failure, cold water, illness, injury and, in rare circumstances, serious injury or death.
You must follow reasonable instructions from TRI FITNESS coaches, venue staff and event organisers; use suitable equipment; behave responsibly; and stop if asked to do so. A coach may modify or stop your participation where there is a reasonable safety concern.
We take reasonable care in delivering our services and maintain appropriate professional insurance. Nothing in these terms excludes or limits liability where doing so would be unlawful.
Participants under 18 must have consent from a parent or legal guardian. The parent or guardian is responsible for providing accurate information and accepting the applicable terms on the young person’s behalf.
3. BOOKINGS AND PAYMENTS
Bookings and payments are normally managed through Bsport or another provider identified at checkout. Prices, payment dates, included sessions, expiry dates and any service-specific conditions are shown on the website, in Bsport or in the booking information supplied to you.
You are responsible for keeping your contact and payment details current. If a payment fails, access to bookings, coaching or membership benefits may be paused until the account is brought up to date. We will not charge an additional failed-payment fee unless it has been clearly disclosed by us or the payment provider.
Bookings and credits are personal to the customer and may not be transferred or resold without prior written agreement.
4. SWIM SQUAD SESSIONS AND SESSION CARDS
PAYG session cards may be used for eligible coached squad sessions, subject to availability. Each card’s price, number of credits and expiry date will be displayed at purchase. Credits must be used before the stated expiry date.
If you cancel a squad booking at least 24 hours before the session begins, the session credit will normally be returned to your account. Cancellations made within 24 hours, and non-attendance, will normally use the credit or incur the full session charge. This allows another swimmer to be offered the place from the waitlist.
We may consider a reasonable extension or exception in cases of serious illness, injury or exceptional circumstances. Requests should be made promptly to paul@3fit.co.uk and are considered individually.
If TRI FITNESS cancels a session, the relevant credit will be returned or an alternative arrangement offered.
Regular Swim Smooth plans provide the number of weekly sessions described when purchased. Payments are collected on the frequency shown at checkout and continue until cancelled. A regular place is subject to the timetable, pool availability and account payments remaining current.
5. 1-TO-1 COACHING AND VIDEO ANALYSIS
The current session duration, price, venue and inclusions are shown on the 1-to-1 page and in Bsport when booking.
Please give at least 72 hours’ notice if you need to cancel or rearrange a 1-to-1 session. Cancellations within 72 hours and non-attendance may be charged at the full rate unless the appointment can be filled or we agree an exception.
If TRI FITNESS needs to cancel, you may choose a replacement appointment or a refund of the amount paid for the cancelled service.
Video analysis may include recording above and below the water, recorded feedback and the secure delivery of footage or analysis files. This material is used to provide your coaching service. It will not be used publicly or for marketing without separate permission.
6. COACHING MEMBERSHIPS
The website currently offers Squad Coaching, Personal Coaching: Single Sport and Personal Coaching: Triathlon. The current price and benefits of each membership are stated on the Coaching page and at checkout.
Membership payments are recurring and are collected in advance through Bsport or its payment provider. A membership continues until cancelled. Unless a different minimum term or notice period is clearly stated at checkout, you may cancel before the next scheduled payment by using the available Bsport account option or contacting paul@3fit.co.uk. Cancellation takes effect at the end of the period already paid for.
Payments already collected are not normally refundable once the membership period has started, except where required by law or where TRI FITNESS agrees otherwise.
Training is delivered using TrainingPeaks and the communication and community channels described during onboarding. Coaching depends on the athlete providing accurate information, completing onboarding, communicating relevant changes and using reasonable judgement when undertaking sessions.
Training plans and coach feedback are guidance based on the information available. You remain responsible for decisions about your health, event participation and whether conditions are safe. Coaching is not a substitute for medical, physiotherapy, nutritional or other regulated professional advice.
Membership changes, pauses because of injury or exceptional circumstances, and transfers between coaching levels may be agreed individually. TRI FITNESS may end or pause a membership for non-payment, unsafe or abusive conduct, persistent failure to engage, or another material breach of these terms. Where reasonably possible, we will explain the issue first.
7. TRAINING CAMPS, CLINICS AND EVENTS
Each training camp, clinic or event may have additional booking terms covering the itinerary, deposit, balance date, inclusions, exclusions, cancellation arrangements and any third-party travel or accommodation provider. These will be supplied before or when booking and form part of your agreement.
Travel, accommodation and related services may be supplied by an independent provider, including Multisport Experience where identified. That provider’s own terms may also apply.
Participants are responsible for passports, travel requirements, suitable equipment, personal travel insurance and insurance covering the planned sporting activities. Camp schedules may be adjusted for weather, venue availability, safety, participant welfare or circumstances outside reasonable control.
If TRI FITNESS makes a significant change or cancels an event, we will explain the available transfer, credit or refund options. Amounts paid directly to an independent supplier are governed by that supplier’s terms.
8. REFUNDS
Session cards, memberships and appointments are not automatically refundable after purchase or once the service has begun, except where required by law or stated in these terms. Please contact paul@3fit.co.uk if you believe a refund or exceptional arrangement is appropriate.
Nothing in these terms removes any cancellation or consumer rights that apply under Guernsey law.
9. PRIVACY NOTICE
9.1 Who controls your information
Tri Fitness Limited is the controller of the personal information described in this notice. We trade as TRI FITNESS Performance and Swim Smooth Channel Islands.

Our use of personal information is governed by the Data Protection (Bailiwick of Guernsey) Law, 2017.
9.2 Information we collect
Depending on how you interact with us, we may collect:
• your name, contact details, date of birth and emergency-contact information;
• enquiry, booking, attendance, payment and membership records;
• coaching information, goals, availability, event plans and TrainingPeaks data;
• health, injury, dietary, accessibility and other information needed to deliver services safely;
• communications, feedback, reviews and marketing preferences;
• photographs, swimming video-analysis footage and recorded coaching feedback;
• technical information such as device, browser, IP address and website or cookie data; and
• information received through Bsport, website forms, Meta lead forms, Zapier, TrainingPeaks or another service you choose to use with us.
Payment-card and Direct Debit details are generally processed securely by the relevant payment provider. TRI FITNESS does not normally receive or store complete card details.
Please do not provide another person’s information unless you have their authority to do so. Parents and guardians may provide information for a child for whom they are responsible.
9.3 Why we use it
We use personal information to:
• respond to enquiries and recommend an appropriate service;
• create and manage bookings, memberships, payments and customer accounts;
• provide coaching, training plans, feedback, video analysis, camps and events;
• protect health and safety and respond to emergencies;
• communicate service information, timetable changes and account matters;
• improve our services and maintain appropriate business, insurance and financial records;
• prevent misuse and protect our legal rights; and
• send marketing where you have consented or where otherwise permitted.
Our lawful grounds may include taking steps at your request before a contract, performing our contract with you, complying with legal obligations, pursuing legitimate business interests that do not override your rights, and consent. Where we process health information or other special-category data, we will identify and rely on an additional lawful condition, normally your explicit consent where required.
You may withdraw consent at any time. This does not affect processing already carried out and does not prevent us using information where another lawful ground applies.
9.4 Service providers and sharing
We do not sell personal information. We share it only where necessary with trusted providers, coaches and professional advisers, or where required by law.
Providers may include Squarespace for the website; Bsport and its payment partners for enquiries, bookings, memberships and payments; TrainingPeaks for coaching delivery; Zapier and Meta for forms and enquiry automation; and appropriate email, video, cloud-storage, analytics, communication and community services.
Providers process information under their own terms and/or our instructions. We take reasonable steps to use suitable providers and appropriate contractual and security protections.
Some providers may process information outside Guernsey. Where required, we use an authorised transfer route or appropriate safeguards under applicable data-protection law.
9.5 Retention and security
We keep personal information only for as long as reasonably necessary for the purpose collected. The period depends on the service, our relationship with you, safety and insurance needs, payment and accounting requirements, potential legal claims and any statutory duties.
We periodically review records and delete or anonymise information that is no longer needed. You may ask about the period applying to a particular record or request deletion, subject to any lawful reason we need to retain it.
We use reasonable organisational and technical measures to protect information. No online system can be guaranteed completely secure, so please contact us promptly if you believe your information may have been compromised.
9.6 Marketing
You can unsubscribe from marketing using the link in a message or by contacting paul@3fit.co.uk. Service and account messages may still be sent where necessary to deliver a booking or membership.
9.7 Your rights
Subject to the Data Protection (Bailiwick of Guernsey) Law, 2017, you may have rights to be informed, access your information, correct inaccurate information, request erasure or restriction, object to certain processing, receive certain information in a portable form, withdraw consent and object to qualifying automated decision-making.

10. COOKIES AND EMBEDDED CONTENT
The website may use essential cookies needed for security and operation, plus analytics, embedded content and third-party features. Embedded services, including social-media or Strava content, may set their own cookies or receive technical information when loaded.
You can control cookies through your browser and any cookie choices displayed on the website. Disabling some cookies may affect how parts of the site work. Please review the relevant provider’s privacy information for third-party content.
11. REVIEWS, PHOTOGRAPHS AND MARKETING CONTENT
We may publish a review, testimonial, photograph or identifiable video only where we have an appropriate lawful basis and, where required, your permission. You can contact us if you wish to discuss or withdraw permission for future use. Withdrawal will not affect material already lawfully published, but we will consider reasonable removal requests.
12. CHANGES, COMPLAINTS AND GOVERNING LAW
We may update these terms when services, providers or legal requirements change. The latest version and revision date will be published on this page. Material changes affecting an active membership or booking will be communicated where reasonably practicable.

These terms and our services are governed by the laws of Guernsey. The Guernsey courts will have jurisdiction, subject to any mandatory rights that apply to you.
